1. Nature of This Platform

NaijaRent is an independent online property listing marketplace. We are not a real estate agent, property developer, estate surveyor, or property valuer, and we do not operate in any of those capacities under the Estate Surveyors and Valuers (Registration, etc.) Decree No. 24 of 1975 (as amended). All property listings on this platform are provided solely by independent third-party landlords, registered agencies, and property owners. NaijaRent does not own, manage, let, develop, or sell any property listed on this platform.

2. Land & Title Rights

Pursuant to the Land Use Act, Cap. L5, Laws of the Federation of Nigeria 2004, all land in each state of Nigeria is vested in the Governor of that state. Individuals and corporate bodies hold a right of occupancy — not outright freehold ownership — over land. Any land or property transaction may require a valid Certificate of Occupancy (C of O) and Governor's Consent to constitute a legally recognised transfer of rights. NaijaRent does not independently verify, guarantee, or warrant the land title, C of O status, survey documents, deed of assignment, or any other documentation associated with any listing on this platform. The presence of a "Verified" or "C of O" badge on a listing reflects information submitted by the listing owner and does not constitute legal confirmation of title. You are strongly advised to conduct independent due diligence and engage a qualified legal practitioner registered with the Nigerian Bar Association (NBA) before entering into any tenancy agreement, property sale, or land purchase transaction.

3. Tenancy Rights & Obligations

Landlord-tenant relationships in Nigeria are primarily governed by state-specific tenancy laws, including — but not limited to — the Lagos State Tenancy Law 2011, the Anambra State Tenancy Law, the Rivers State Rent Control and Recovery of Residential Premises Law, and their equivalents in other states and the Federal Capital Territory (FCT). Under applicable Nigerian tenancy law: • Tenants have the right to peaceful enjoyment of rented premises free from harassment or unlawful interference by landlords. • Landlords are prohibited from carrying out self-help evictions. Lawful eviction requires a valid court order obtained through due process. • Minimum notice periods apply: not less than one week's notice for weekly tenancies, one month's notice for monthly tenancies, and six months' notice for yearly tenancies, unless otherwise agreed in a written tenancy agreement. • Landlords are required by law to issue a written receipt for every rent payment received. • Tenants are constitutionally protected under Section 43 of the 1999 Constitution of the Federal Republic of Nigeria (as amended), which guarantees the right to acquire and occupy immovable property. NaijaRent is not a party to any tenancy, licence, or other occupancy agreement formed between users of this platform. Any such agreement is solely between the landlord and the tenant.

4. No Guarantee of Listing Accuracy

Listings on NaijaRent are submitted by third parties. While we apply a manual review process before listings go live, we make no representation, warranty, or guarantee — express or implied — as to the accuracy, completeness, currency, or fitness for purpose of any listing, property description, photograph, price, or other information displayed on this platform. Prices quoted on listings are indicative only and may not include additional costs such as agency fees, legal fees, stamp duties under the Stamp Duties Act, or service charges. Always verify all details directly with the property owner or their authorised representative before making any payment or commitment.

5. Consumer Rights Preserved

Nothing in these terms, our Terms of Service, or any other document published by NaijaRent is intended to limit, exclude, or waive any rights you hold as a consumer under the Federal Competition and Consumer Protection Act (FCCPA) 2018 or any other applicable Nigerian consumer protection legislation. Your statutory rights remain fully intact.

6. Data Protection

NaijaRent collects and processes personal data in accordance with the Nigeria Data Protection Act (NDPA) 2023 and the regulations issued thereunder by the Nigeria Data Protection Commission (NDPC). This includes your right to access, rectify, and request erasure of your personal data. 7. No Professional Advice

Nothing on this platform constitutes legal, financial, investment, tax, or real estate valuation advice. All content is provided for general informational purposes only. For any matters concerning property title, land law, tenancy agreements, stamp duties, investment decisions, or property valuations, please consult a qualified legal practitioner registered with the Nigerian Bar Association (NBA) or a registered estate surveyor and valuer accredited by the Estate Surveyors and Valuers Registration Board of Nigeria (ESVARBON).

8. Limitation of Liability

To the maximum extent permitted by applicable Nigerian law, NaijaRent shall not be liable for any direct, indirect, incidental, consequential, or punitive loss arising from: (a) reliance on any listing, information, or content on this platform; (b) any transaction entered into between users of this platform; (c) the failure of any landlord, agency, or property owner to comply with applicable Nigerian law; or (d) any dispute between a landlord and a tenant. This limitation does not apply to any liability that cannot be excluded under the FCCPA 2018 or any other applicable mandatory Nigerian law.

9. Governing Law

This disclaimer and your use of NaijaRent are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute arising out of or in connection with this disclaimer shall be subject to the non-exclusive jurisdiction of the Nigerian courts.
